Presumption of Information Reliability in State Information Systems

Abstract: 

Introduction. In modern conditions, the role of public information systems as a special tool for influencing public relations is increasing in various spheres related to public administration. In this regard, it is relevant to study the legal regime of such systems and, in particular, the legal regime of information that constitutes their information resource. Theoretical analysis. In accordance with the law, information contained in government information systems is official. In the Russian legislation this concept does not have a legal definition, but it is reinforced by the duty of state bodies to ensure the reliability of such information. Empirical analysis. Law enforcement practice proceeds by recognizing the rights of citizens and other persons to exclude unreliable information from state information systems, as well as recognizing the document not submitted to the state body if it contains inaccurate information. It is not sufficient to ensure the rights of persons using official information. Results. In the author‘s opinion, the main sign of official information is the presumption of reliability, which implies not only the duty of the state to ensure the reliability of official information, but also the corresponding guarantees to its users including the recognition of good faith behavior based on the use of such information. At the same time, not any state information systems can objectively serve as a source of official information. This requires an appropriate clarification of the law.
