Specifics of the participation of citizens of the Russian Federation in election campaigning at the present stage
Introduction. The article examines general issues of citizens’ participation in election campaigning, defines the boundaries of such participation, and offers the author’s vision of the transformation of this process in the context of the ongoing digitalization of electoral processes. The relevance of the study is due to a comprehensive constitutional and legal understanding of citizens’ participation in election campaigning. Theoretical analysis. Taking into account the fact that the legitimate conduct of election campaigning is the only tool for encouraging voters in the framework of the ongoing election campaign, the purpose of the article is to identify the specifics of the legal regulation of a set of measures and the specifics of activities carried out within the framework of election campaigning, based on the analysis of legislative acts regulating relations arising during elections and referendums, as well as to identify areas that can improve the implementation of this procedure, including those in the context of the development of digital society. Empirical analysis. The research relied on formal legal, logical, as well as general scientific methods (analysis, synthesis, dialectical method). The artlicle draws attention to the practice of implementing legal norms prohibiting the conduct of election campaigning, as well as to the lack of regulatory consolidation of the Internet as an element of the list of information resources provided for in paragraphs 8 and 8.1 of Article 48 of the Federal Law of June 12, 2002. Federal Law 67-FZ “On Basic Guarantees of Electoral Rights and the Right of Citizens of the Russian Federation to Participate in a Referendum”. Results. The study revealed an ambiguous understanding of the term of “election campaigning”, as well as the need to improve current legislation aimed at developing election campaigning on the Internet.
