The problem of goals and tasks in criminal justice is aggravated by the absence of these categories in the Criminal Procedure Code. At the same time, the legislator introduces a new category, the category of criminal justice purpose, into the Code. Such categories as goals, tasks, and functions of criminal justice should be differentiated, their role in legal procedures should be shown, and the category of criminal justice purpose should be brought out.

Introduction. The article investigates the purposes and principles of the constitutional rights and freedoms of the limitations of citizens of the Republic of Iraq in emergency legal regimes. The author deals with the problems arising from the establishment and application restrictions. On the basis of the existing constitutional practice the necessity of leveling the negative consequences of the introduction and implementation of the legal regime of emergency by the state.
