Abstract:

Introduction. The criterion of the rational use of the agricultural land is traditionally defined as one of the key factors that ensure food security of the state. The need to comply with the requirements of the rational land use is indicated in a number of regulatory legal acts. Meanwhile, the content and meaning of this criterion is not disclosed in the legal acts, which makes it difficult to assess its regulatory impact in the field of the use and protection of the agricultural land, and in this context actualizes the need to identify its main characteristics. Theoretical analysis. Doctrinal legal approaches to the criterion of rationality have been analyzed, its legal nature has been determined as a landmark of public authorities in the formation and implementation of the main directions of the state land policy, as well as the implementation of economic activities on the agricultural lands. Empirical analysis. The regulatory legal acts were analyzed for their compliance with the criterion of rationality, legal problems arising in this area were identified. Results. It was concluded that rationality acts as a legal concept that collectively reflects the requirements of legality, justice, reasonableness and expediency in the implementation of any activity related to the use and protection of land and implemented in law-making and economic use of the agricultural land.
