Analytical Overview of the Contents of Criminal Punishment the Example of the Arrest: Theses
Introduction. There is a theory according to which the criminal penalties content is determined by a system of restrictions and deprivation prescribed specific punishment, in our opinion, does not hold water. In modern conditions it should include: basic restriction and deprivation, based on the Russian Constitution and federal legislation; basic, reflecting the essence of a specific criminal penalties and its mode of serving; electives, which include competency features of the subject of the sentence and subjective factors of the persons performing and serving the sentence imposed. Theoretical analysis. Considering the example of the representation theory of criminal punishment in the form of arrest, we can conclude that to convict applies a high level of basic restrictions and deprivation. Mainly consists in the deprivation of liberty, and in addition, as a result, implemented restrictions in employment, financial constraints, and there is moral and psychological impact caused by the fact of conviction. penal regime due to the volume of duties and prohibitions, regulations and forms of responsibility, aimed at ensuring proper execution and punishment during his course. The essence of competency features of activity of subjects of execution of arrest, in particular with regard to personnel associated with the small number of places serving this punishment. The content of subjective factors is due to the peculiarities of the special contingent - the military: a high level of responsibility and discipline, and loyalty attitude towards prisoners. Conclusion. In the example shown that the presented elements of the base and the main character is determined potential punitive punishment and optional regulate its volume.
