The concept «the social state» all is wider, especially last years, is used in domestic economic, political, jurisprudence. In the scientific article attempt of judgement of substantive provisions of the concept of the social state is undertaken.

Introduction. The Particularity modern european constitution is connected with fastening active dug the state in economic relations. This is connected with that that model of the legal registration of the most important sides is thought-out on its essence Constitution to lifes of the separate person and society as a whole, she «forms the mechanism of the combination of national valuables and ideal with process, typical of modern civilization regardless of social as a whole, national or territorial frames, in which she develops» [1, p. 66].

Introduction. Social justice as an axiological characteristic of a modern state is on the national and international agendas. The major functions of the social state in Russia, that reveal its essence and are stipulated in the Constitution of the Russian Federation, are the decent life and free development of a person. The constitutional law research does not provide a uniform opinion concerning determinant importance of the given categories for the social state.

Тhe article deal with the attempt of theoretical legal understanding the problem of the right to life as the complex social and political phenomena and the basis of tenolencees of its development in modern Russia. Some aspects of formalization of the right to life, which are necessary for the decision of the important tasks of the Russian State are analyzed.
