Problems of Determination of the Term "Cultural Values" in the Legislation of Russia
Introduction. Now legal regulation of the relations as which object cultural values act is performed by a number of the regulatory legal acts relating to various industries of the right. Implementation of legal relationship which object are cultural values meets some difficulties connected with imperfection of legal regulation of turnover of the specified object of the rights. Purpose. The main objective of work consists in theoretical judgment of the concept “cultural values” and development of recommendations about enhancement of legal regulation. Results. It is stated that in the legislation of Russia there is no single legal determination of the term “cultural values”. In regulations the term “cultural values” is understood in various values that leads to its double interpretation and difficulties in law enforcement. Owing to lack of legal determination of the term “cultural values” in practice there can be problems with qualification of cultural value as object of legal relationship. Article is devoted to a research of category “cultural values” in the administrative and legal and civil legislation. The definitions given in special literature and the national right are analysed. Conclusion. The author comes to a conclusion that it is necessary legislative unification of determination of category “cultural values”.
